On Wednesday 17th January, Sargent-Disc held a contracting seminar in association with UK Screen Alliance at Warner Bros. De Lane Lea in London. Chaired by Dr. Laurence Sargent, Director of Sargent-Disc, the panel focussed on the importance of contracting freelancers and staff whilst striving to enhance attendees' knowledge of the processes involved.

 

Neil Hatton, CEO of the UK Screen Alliance welcomed attendees and introduced seminar chair Laurence Sargent, who in turn introduced the panel.

Is contracting worth the effort?:

 

James Peel shared the benefits of contracting - including the significance of signatures and timestamps in greatly reducing employment disputes in the workplace. Digital signatures on contracts are valid under UK law and therefore make for effective evidence.

 

James also ran through the essential contracting clauses and the differences between employing crew as direct hires or contracting them as loan outs. It is often simpler to engage crew as direct hires, but there are compliance risks related to holiday pay and pensions.

 

Issues with paper contracting processes:

 

Addressing the problems of paper-based contracting processes, Iain Pelling outlined some of the challenges when contracting for different production roles and grades.  With large numbers of employees across multiple projects and locations, it can be difficult to track and report , as well as ensuring compliance with HMRC and DWP requirements. In addition, the entire process of creating, issuing and approving paper documents is very time consuming. Iain pointed out that CrewStart™, Sargent-Disc's onboarding system, simplified the contracting process for Arrow Media and helped with delivery to commissioners.

 

Iain also pointed out that employers must ensure Right to Work and Diversity information is captured when contracting crew and freelancers. Certain documentation such as Equipment Riders also need to be delivered to freelancers - an important in differentiating them from employees.
